Welcome to CloudPod AI. By accessing or using our website (cloudpodai.com), services, applications, or any related products (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

1. Definitions

"CloudPod AI" refers to the private AI infrastructure platform operated by CloudPod AI ("we", "us", "our").

"Lite Mode" refers to the free demo chat experience available on our website, limited to 5 messages per session.

"Full Mode" refers to the dedicated GPU-powered AI service available to authorized users and paying customers.

"User" refers to any individual or entity accessing the Service.

2. Service Description

CloudPod AI provides private, self-hosted AI infrastructure for businesses. Our Service includes:

• Lite Mode (Free Demo): A limited demo experience powered by third-party AI APIs. Limited to 5 messages per session. Not intended for production use.
• Full Mode: A dedicated, self-hosted AI environment running on private GPU infrastructure, available to authorized users and subscribers.

3. Free Demo Limitations

The Lite Mode demo is provided "as-is" for evaluation purposes only. We reserve the right to:

• Limit the number of messages per session
• Modify, suspend, or discontinue the demo at any time without notice
• Change the underlying AI provider or model used in the demo
• Rate-limit or restrict access based on usage patterns

The demo does not represent the full capabilities of CloudPod AI's paid service.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate, request, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Create NSFW, sexually explicit, or pornographic content
• Generate violent, gory, or graphic content depicting harm to people or animals
• Create content promoting terrorism, extremism, or hate speech
• Generate content depicting or exploiting minors in any way
• Create deepfakes or misleading representations of real individuals
• Generate content related to illegal drugs, weapons manufacturing, or other criminal activities
• Attempt to bypass content filters, safety measures, or usage restrictions
• Use the Service for any activity that violates applicable laws or regulations
• Reverse-engineer, scrape, or exploit the Service beyond its intended use
• Overload or abuse the API through automated or excessive requests

Violation of these terms may result in immediate termination of access without notice.

5. Content & Intellectual Property

Your Content: You retain ownership of text prompts you submit and the AI-generated responses you receive. However, similar content may be generated for other users based on similar prompts.

Our Content: All website content, branding, design, logos, and code related to CloudPod AI are owned by us and protected by intellectual property laws.

AI-Generated Content: Content generated by the AI is provided for informational purposes only. We make no claims about the accuracy, originality, or suitability of AI-generated content. You are responsible for reviewing and verifying any AI-generated content before use.

6. Third-Party Services

Our Lite Mode demo may use third-party AI APIs and services (such as Pollinations.ai) to provide AI capabilities. Your use of the demo is also subject to the terms and policies of these third-party providers. We are not responsible for the availability, accuracy, or conduct of third-party services.

7. Privacy & Data

Lite Mode: Messages sent in Lite Mode may be processed by third-party AI providers. We do not store your conversations, but third-party providers may process them according to their own privacy policies.

Full Mode: Full Mode runs entirely on dedicated, private infrastructure. Your data is not shared with any third parties. Conversations and uploaded files remain within your private environment.

We do not sell, trade, or rent your personal information to third parties.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, complete, or appropriate
• The Service will meet your specific requirements
• Any defects will be corrected

9. Limitation of Liability

To the maximum extent permitted by law, CloudPod AI and its founders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use or inability to use the Service
• Any AI-generated content or its accuracy
• Unauthorized access to your data or transmissions
• Any third-party conduct on the Service

10. Payment & Subscriptions

Paid plans are billed as agreed upon in your service agreement. Custom pricing is determined based on your team size, usage requirements, and infrastructure needs. All fees are non-refundable unless otherwise specified in your agreement.

11. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
